FranLew.com receives, collects, and stores any information you enter on our website or provide to us in any other way. We use this information to contact you, our Visitors and Users with general or personalized service-related notices and promotional messages; To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we  may use to provide and improve our respective services; To comply with any applicable laws and regulations. FranLew.com will not offer and/or sell your information to any third party. 

Requests for User Information

We disclose account records solely in accordance with our Privacy Policy and applicable law, including the federal Stored Communications Act (“SCA”), 18 U.S.C. Sections 2701-2712. Under the SCA:

a valid subpoena issued in connection with an official criminal investigation is required to compel the disclosure of basic subscriber records (defined in 18 U.S.C. Section 2703(c)(2)), which may include: name, length of service, credit card information, email address(es), and any recent login/logout IP address(es), if available.

a court order issued under 18 U.S.C. Section 2703(d) is required to compel the disclosure of certain records or other information pertaining to the account, not including contents of communications, which may include message headers and IP addresses, in addition to the basic subscriber records identified above.

a search warrant issued under the procedures described in the Federal Rules of Criminal Procedure or equivalent state warrant procedures upon a showing of probable cause is required to compel the disclosure of the stored contents of any account, which may include messages, photos, comments, and location information.

It is important to note that some information we store is collected automatically, while other information is provided by the user. We do not require email or phone verification, and we do not require people to use real names or identities on FranLew.com. Data Retention and Availability
We retain different types of information for different time periods. Given the volume of content on FranLew.com, some information may only be stored for a short period of time. We do not retain data for law enforcement purposes unless we receive a legally valid preservation request.

Information to Include
All requests must identify the following:
The name of the issuing authority, badge/ID number of responsible agent, email address from a law enforcement domain, and a direct contact phone number. The username of the FranLew.com account in question on the date you viewed the account and details regarding specific information requested and its relationship to your investigation. Usernames are not static and we are unable to process requests that do not include the date viewed combined with the username. 

FranLew.com is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to show our artwork and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. FranLew.com does not use cookies.

This Privacy Notice for California Residents supplements the information contained in The Art of Fran Lew’s Privacy Policy and applies solely to all visitors, users, and others who reside in the State of California. We adopted this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and any terms defined in the CCPA have the same meaning when used in this notice

We may use or disclose the personal information we collect for one or more of the following business purposes: To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to request a price quote or ask a question about our services, we will use that personal information to respond to your inquiry. If you provide your personal information to purchase a product or service, we will use that information to process your payment and facilitate delivery. We may also save your information to facilitate new product orders or process returns. To process your requests, purchases, transactions, and payments and prevent transactional fraud. To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses. Deletion Request Rights

 

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

Exercising Access, Data Portability, and Deletion Rights

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

 

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

 

Provide sufficient information that allows us to reasonably verify you are the person about whom we’ve collected personal information or an authorized representative. Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

 

Response Timing and Format

 

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.

 

We will deliver our written response by mail or electronically, at your option.

 

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

 

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

Personal Information Sales

 

We will not sell your personal information to any party. If in the future, we anticipate selling your personal information to any party, we will provide you with the opt-out and opt-in rights required by the CCPA.

 

Non-Discrimination

 

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not: Deny you goods or services. Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties. Provide you a different level or quality of goods or services. Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Access
You may not use this site in any manner that could damage or overburden any FranLew.com equipment or software. You may not use any means of systematic retrieval of data or other content from this site. You may not obtain, or attempt to obtain, access to any material or information on this site that is protected by passwords, PIN or required login identification through any means not expressly authorized by FranLew.com You may not use the login information of another person, unless they specifically authorized you to do so.

Jurisdiction and Enforceability
Governing Law
Use of this site shall be governed by and construed in accordance with the laws of the State of Florida without giving effect to any principles of conflicts of laws.

If any provision of these Terms is held unlawful, void or unenforceable, the remaining provisions shall remain valid and in effect to the fullest extent possible.

Jurisdiction and Venue
For any claim or dispute that arises under these Terms, exclusive jurisdiction and venue shall be with a court of competent jurisdiction in Palm Beach County, Florida. You consent to the jurisdiction of such courts and agree to accept service of process issued by such courts.

Endorsements
You may not use Fran Lew's name or trademarks in any way that implies affiliation with, or an endorsement, sponsorship or approval by Fran Lew without express written permission. 

Licensed Materials
Various text, forms and images appearing on this site are used under license by FranLew.com for this site. These materials are for viewing purposes only. Any reproduction may be prohibited under federal/state copyright or trade secret laws.
 

Miscellaneous
Personal Use Only

Waivers
